Preliminary Provisions
Online Store Digidon
The website www.digidon.ro (“the Website”) is managed by DIGIDON PLUS SRL, as the seller, headquartered at: P-ta 1 Mai nr 4 – 5 400141, Cluj Napoca, Cluj County, registered with the Trade Registry at the Cluj Tribunal, identification number J12/4975/05.11.2018, unique registration code (CUI) RO40105049, (“the Seller”).
This document establishes the terms and conditions for using the Website and the conditions for purchasing products sold through the Website (hereinafter referred to as “Terms and Conditions”). These Terms and Conditions encompass the rights and obligations of the parties arising from or related to the sale-purchase contract (“the Contract”) concluded between the Seller and an individual buyer via the Website.
2. Buyer
The Buyer is any natural person who, by placing an online order on the website, acts for purposes other than those specific to their commercial or professional activities, having, according to the law, the status of a consumer (“the Buyer”).
3. General Terms and Conditions
These Terms and Conditions are an integral part of the Contract concluded between the Buyer and the Seller and include the rights and obligations of the parties (as defined below).
By concluding the sale-purchase Contract, the Buyer agrees and accepts these Terms and Conditions in their entirety.
4. Definitions
The Contract represents the understanding concluded electronically between the Seller and the Buyer through the Seller’s online store (as defined below).
Online Store – an online system operated via the internet, allowing the Seller and the Buyer to conclude the Contract through remote communication. The Online Store is operated on a website located at https://www.digidon.ro.
Products and Services – Any product or service, including the documents and services mentioned in the Order, which are to be supplied or provided by the Seller to the Buyer and are represented by furniture, office accessories, and/or decorations purchased by the Buyer, which correspond to the description in the manufacturer’s catalogs and documentation, the characteristics of which have been agreed upon by the Buyer and recorded in the order or invoice.
Order – an electronic document that serves as a means of communication between the Seller and the Buyer through which the Seller agrees to deliver the Goods and Services and the Buyer agrees to receive these Goods and Services and to pay for them.
Campaign – the action of displaying a finite number of products with a limited and predefined stock for a limited time period established by the Seller for commercial purposes, in electronic format, TV, within the Digidon Store, or via the Website.

Goods Offer
The Seller takes all measures to ensure that the information published on the Website, including the description of Products and Services, as well as the listed prices, are correct and complete at all times. However, in the event of errors in publishing the aforementioned information, the Seller will attempt to rectify all errors as soon as possible. If the Seller finds that the error has affected/influenced the Buyer’s Order or the valid Contract concluded, they will inform the Buyer as soon as possible, offering them the opportunity to reconfirm the Order/Contract and the possibility of canceling it.
At the time of placing the order on the Website, the Buyer should consider the following aspects:
The colors of the Goods, as presented on the Website, may differ in reality, depending on several factors, including, but not limited to, the settings of the Buyer’s monitor;
The dimensions are specified in the description of the Goods.
Goods will be delivered only to the extent that they are available. Digidon reserves the right to withdraw any Goods from sale at any time. In such situations, Digidon’s only responsibility to the Buyer is the full refund of the amounts paid for the respective Goods that it can no longer supply/has withdrawn from sale.
Digidon makes every effort to deliver the Goods within a maximum of 15 working days after the confirmation of the order. Please note that all delivery information provided by Digidon (on the website, by phone, or via email) is for estimation purposes only and, therefore, may vary from case to case. Please consult Section 3 – Delivery of Goods for more information about delivery.
Digidon reserves the right to freely adjust, in compliance with legal provisions, prices and special offers.
The Seller reserves the right to make any changes to the content of the Online Store, including prices. Offers (including discounts, promotional sales, and promotional brochures) are valid within the limits of available stock or for a certain period. Prices are applicable at the time of placing the Order.
All prices for Goods and services (e.g., delivery) are stated with VAT included, except for explicit mentions that prices do not include VAT.
Order
By placing an order on the site, the Buyer agrees to the form of communication (email, SMS, phone) through which the Seller conducts its operations on the site.
The Seller will inform the Buyer, through distinct messages, of the registration (taking) of the order, respectively the confirmation of the order. The registration of an online order by the Seller, telephone discussions, or through other means of communication do NOT constitute a validation and firm confirmation of the order and, consequently, do NOT signify the conclusion of the contract at a distance.
If the Seller explicitly confirms an order, this will imply a complete acceptance of the terms of the order. Acceptance of the order by the Seller is considered completed when there is a written confirmation (email, SMS) from the Seller to the Buyer, without requiring an acknowledgment of receipt from the latter.
The order is considered valid only after the Seller confirms the availability of stock, the price, and the characteristics of the products or services requested by the Buyer.
In the absence of an explicit confirmation from the Seller, these general terms and conditions of sale will form the basis of the concluded Contract, supplemented by the Warranty Certificate issued by the Seller and the fiscal documents (Goods Invoice and Services Invoice).
The Buyer registers on the Website using a unique username and password, selects the products, expresses agreement with the Terms and Conditions of the online store https://www.digidon.ro, and then clicks the “Add to Cart” button. In “My Cart,” the customer has the opportunity to review the list of products, modify quantities, and confirm the intention to purchase by clicking the “Complete Order” button. After completing the order, the customer will receive a written confirmation from the Seller regarding the availability, price, and characteristics of the ordered products and services for validation.
Once validated, the Order cannot be modified by the Buyer. If you wish to modify/cancel it, you can contact us by email (office@digidon.ro) or at the phone numbers displayed on the site in the contact section.
In the case of custom-made products, the details of the order will be confirmed by the Seller via email. The order will be considered finalized upon the crediting of the Seller’s account with a 50% advance payment of the price of the ordered Goods.
Delivery
Delivery is made to the delivery address specified by the Buyer in the order form, using external courier services or the internal delivery team. If an order contains multiple products with different delivery times, a single delivery will be made within the timeframe established by the Seller, according to the availability displayed on the site at the time of placing the order.
The products are in their original, sealed packaging from the manufacturer and are insured throughout transport until delivery. The Buyer is obliged to unpack and verify the packages in terms of quantity and quality, based on their labeling, to unpack and check the integrity of fragile packages as well as the fragile components packaged (e.g., glass parts).
The Seller will notify the Buyer regarding the estimated delivery completion date.
Delivery times are displayed on the site for each product and vary by product. However, delivery times may be unilaterally modified by the Seller if they are affected by transport delays due to circumstances beyond the Seller’s control, or by the intervention of authorities in the transport/checking/taxing/delivery process.
If the packaging is not intact, the Seller recommends that the Buyer refuse to accept the Goods from the carrier and send an email to inform the Seller at the email address office@digidon.ro. By signing for receipt, the Buyer confirms that the packaging of the Goods is intact.
Any complaints regarding mechanical defects of the Goods, delivery of goods other than those ordered, etc., which were not reported upon receipt from the carrier, will be reported by the Buyer immediately upon identification, but no later than 3 days from the receipt of the Goods. The Seller will be held liable for damages caused to the Goods during transport only if the Buyer reports such damages immediately, in accordance with the provisions of these Terms and Conditions.
If the Seller receives incorrect information regarding the billing or delivery of products, rejection by the issuing bank of the card or the transaction, invalidation of the transaction by the card processor, or postponement by the Buyer of the established delivery date, the Seller reserves the right to unilaterally terminate the contract, without this being considered a breach of the Contract.
If, due to reasons attributable to the Buyer (such as, but not limited to: refusal to accept the package, absence from the communicated delivery address, refusal to pay for the package), the Goods need to be delivered repeatedly or through a method different from that initially requested in the Order, the Buyer is obliged to bear all costs incurred by the repeated deliveries.
Payment
The prices displayed on the website are expressed in LEI and include all applicable taxes.
VAT applies to the legal value at the time of the order and is included in the prices of Goods and/or services.
The prices of the products displayed on the website exclude delivery costs and costs of other optional services.
The Seller offers the following payment methods: cash on delivery, card payment, and electronic transfer.
Electronic transfer means that the purchase price, including any delivery costs or other costs of other optional services you have selected (“Transaction Price”), must be paid into the Seller’s bank account before the Goods are shipped. To process the Order as quickly as possible, the Seller recommends mentioning the order number allocated to the Order, as communicated to the Buyer at the time of completing the Order, as a reference code. In the case of payment by electronic transfer, the Transaction Price is considered paid when the amount for the Order has been credited to the Seller’s bank account.
Payment by card means that at the time of finalizing the Order, the Buyer will be redirected to a third-party payment server, where they will complete the payment information. The information will be verified, the Order confirmed, and the purchase price will be withdrawn from the Buyer’s bank account.
Rights and Obligations under the Sale-Purchase Contract
The Seller is obliged to deliver the ordered Goods to the Buyer at the agreed purchase price, and the Buyer is obliged to pay the transaction price and to receive the Goods.
The Buyer is obliged to provide true and correct information in the Order. The Seller will consider all data provided by the Buyer, which is necessary for concluding the sale-purchase contract, to be true and correct.
The Seller has no obligation to the Buyer regarding any Code of Conduct under Art. 8 para. 1 lit. e) of Law no. 365/2002 regarding electronic commerce.
To amicably resolve consumer complaints, the Buyer will contact: office@digidon.ro. The Seller will inform the Buyer regarding the result of the complaint procedure via electronic means, at the email address communicated by the Buyer.
Discount Coupons and Vouchers
The Seller offers various types of discounts; discounts are also granted in the form of discount coupons or vouchers which most frequently include discount codes.
Discount codes and vouchers cannot be used repeatedly except in cases where the respective coupon or voucher expressly states otherwise.
Discount coupons and vouchers cannot be combined or used together unless the respective coupon or voucher expressly states otherwise.
In the event that the discount or discount coupon is used other than in accordance with the rules of the discount offer, the coupon, or the voucher, the Seller has the right to refuse the discount, the discount coupon, or the respective voucher. The Buyer will be informed accordingly and given the opportunity to place the Order without the requested discount. In the event of misunderstandings/ambiguities regarding the interpretation of the rules applicable to discounts or discount coupons, the provisions of these Terms and Conditions will prevail.
If you place an Order for multiple products and one is not available, The Home will inform you accordingly. The rest of the Order will be processed and shipped according to the customer’s request.
Return Policy
According to the applicable legislation, the Buyer has the right to notify the Seller in writing that they are renouncing the purchase, without penalties and without stating a reason, within 14 calendar days from the receipt of the product, bearing the costs of return.
The Buyer is informed that if the Goods being returned show signs of wear, scratches, dents, mechanical shocks, or, as applicable, missing accessories, missing warranty certificates, the Seller reserves the right to decide on the acceptance of the return or to withhold an amount from the price of the Good, an amount that will be communicated after evaluating the damage caused. In the event of exercising the legal right to return the product, the reimbursement of its value will be made no later than 14 days from the date of requesting the return, subject to the quantitative and qualitative reception of the return, according to this policy, by the same payment method.
The Buyer only bears the direct costs related to the return of the Goods, unless the Seller agrees to bear those costs.
The Buyer is only responsible for the decrease in value of the products resulting from handling them, different from what is necessary to determine the nature, characteristics, and functioning of the products.
Delivery and transport are distinct services provided by us, which involve the Buyer’s option and payment of a price. For the service of returning the goods, the services of delivery and transport of the Goods are excluded from exercising this right if the Buyer has previously expressed explicit agreement for their execution.
The following products are excluded from exercising the right of return: products made according to the specifications and instructions of the Buyer or customized specifically for them, products that can deteriorate or degrade rapidly, products that are part of an assembly and cannot, by their nature, be separated from the other component elements.

Warranties and Service
The Seller ensures and guarantees the conformity of the purchased goods as well as any hidden defects, declaring on their own responsibility that the marketed products do not endanger life, health, or occupational safety, do not have a negative impact on the environment, and comply with Government Ordinance no. 20/2010 regarding establishing measures for the uniform application of European Union legislation harmonizing the conditions for the marketing of products, the manufacturer’s execution documentation, and Romanian standards.
The Seller undertakes to deliver the product in accordance with the description on the website https://www.digidon.ro/ and with the qualities and characteristics recorded in the invoice. The product is considered non-compliant if it does not have the same qualities as described on the website https://www.digidon.ro/ or if it does not have the qualities and characteristics inscribed on the invoice. The Seller’s liability is engaged if the lack of compliance of the product appears within a period of 2 years calculated from the date of delivery and if the Buyer informs the Seller about the appearance of the lack of compliance within 2 days from the date they became aware of it. In the case where a lack of compliance of a product from the invoice is identified at the time of delivery, the Buyer has the right to request repair within a reasonable period or replacement of the product. If these operations are not possible, the Buyer has the right to request a corresponding reduction of the price or termination of the Contract regarding that non-compliant product.
The Buyer is obliged to notify the absence of a component in the package before starting the assembly and to keep the labels and contents of the package in the condition in which they were received for verification and replacement. The Seller assumes no liability for the execution and consequences of handling, transport, assembly, and installation services performed by third parties when the services are not provided by the Seller.
For the product to benefit from the warranty and services provided by the Seller, the Buyer must retain the original invoice that certifies the purchase of the product and provide it upon request.
The warranty period is 24 months from the date of delivery for furniture and home decor. The warranty applies only to the components of the product that are determined by the technical sheet of the product. The Seller assumes no responsibility for damages caused by improper use of the products (including but not limited to, improper assembly, lack of maintenance, or exposure to aggressive substances). The warranty does not cover normal wear and tear of the product.
Final Provisions
Any notifications from the Seller to the Buyer or from the Buyer to the Seller will be made in writing, including by email, to the address mentioned in the invoice.
The Seller is exonerated from liability in case of force majeure events that prevent or delay the execution of the sale-purchase contract.
All disputes arising from the application of these Terms and Conditions will be settled amicably or, if this is not possible, will be resolved by the competent courts according to the legal provisions.
